1) Acceptance of Terms

By accessing or using aishvera.com (“Site”) or purchasing our products, you agree to these Terms & Conditions (“Terms”), our Privacy Policy, Shipping Policy, and Refund & Return Policy. If you do not agree, please do not use the Site.

2) About Aishvera

Aishvera (“Aishvera”, “we”, “us”, “our”) is a jewellery brand offering minimalistic silver jewellery inspired by world spirituality.

3) Eligibility & Account

  • You must be 18+ (or the age of majority in your jurisdiction) to purchase.
  • You’re responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

4) Product Information & Care

  • We strive for accurate descriptions and images; however, minor variations in color/finish may occur due to screen settings, lighting, or natural characteristics of silver and stones.
  • Silver naturally oxidizes over time. Regular gentle cleaning restores shine; this is not a manufacturing defect.
  • Dimensions/weights are approximate; handcrafted elements may vary slightly.

5) Pricing, Taxes & Availability

  • Prices are shown in INR and may change without notice.
  • Unless specified otherwise, prices are inclusive of applicable taxes (e.g., GST).
  • We may correct pricing/stock errors at any time and cancel/refund orders affected by such errors.

6) Orders & Acceptance

  • Your order is an offer to buy; our acceptance occurs when we dispatch the product(s) and share tracking details.
  • We may refuse/cancel any order (e.g., suspected fraud, incorrect pricing, stock limits, address serviceability). Any amounts paid will be refunded.

7) Payments

  • We accept online payments via Razorpay (cards, UPI, net-banking, and wallets as available).
  • For COD (if enabled), eligibility, fees, and limits are shown at checkout. Repeated COD refusals may restrict COD for future orders.
  • We don’t store your full payment credentials; processing is handled by your selected provider.

8) Shipping & Delivery

  • Next-day dispatch on business days (Mon–Sat, excluding public holidays).
  • Delivery via Shiprocket’s courier network and Blue Dart, subject to PIN-code serviceability.
  • Indicative delivery times: 2–4 business days (metros), 3–7 business days (non-metros/remote).
  • Title and risk pass to you upon delivery to your address/carrier as per applicable law.

9) Returns, Exchanges & Refunds

  • 7-day return window from delivery; item must be unworn/unused with tags, pouches/boxes, and invoice.
  • For hygiene reasons, certain categories (e.g., earrings if the seal is broken) may be non-returnable.

  • Refunds are initiated within 2 business days after QC approval; bank reflection depends on your issuer.

10) Promotions, Coupons & Store Credit

  • Promo codes are single-use unless stated, non-transferable, and may have category/cart value/PIN restrictions.
  • If you return items bought with a coupon, the discount may be proportionately adjusted; shipping/fees may be non-refundable.
  • Store Credit/Gift Cards (if issued) are non-withdrawable cash equivalents and valid until the stated expiry.

11) User Content & Reviews

  • By posting reviews, Q&A, photos, or other content (“User Content”), you grant Aishvera a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute such content for marketing or operational purposes.
  • You represent that your User Content is accurate, lawful, and does not infringe third-party rights. We may moderate or remove content at our discretion.

12) Permitted Use & Prohibited Activities

You agree not to:

  • Use the Site for unlawful purposes or to violate any regulations.
  • Copy, scrape, or harvest content/data without permission.
  • Attempt to bypass security, interfere with the Site, or upload malware.
  • Purchase for resale without prior written authorization.

13) Intellectual Property

All content on the Site—logos, product designs, text, graphics, images, videos, icons, and software—is owned by or licensed to Aishvera and protected by IP laws. You may not reproduce or exploit Site content without our prior written consent.

14) Third-Party Services

We integrate with third parties (e.g., Razorpay for payments; Shiprocket/Blue Dart for logistics; Meta & Google for ads/analytics; WhatsApp for support). Your use of such services may be subject to their own terms and privacy policies.

15) Communications & WhatsApp

By providing your phone/email, you consent to receive transactional messages (order updates, delivery, returns) and, where permitted, promotional updates. You can opt out of marketing anytime (instructions provided in messages). Standard carrier/data charges apply.

16) Privacy

Our Privacy Policy explains what personal data we collect and how we use/share it, including DPDP-aligned notices, consent, and grievance redressal. Please review it carefully.

17) Warranties & Disclaimers

  • Products are provided “as is” subject to manufacturing QC. Natural wear/oxidation is expected for silver.
  • To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

18) Limitation of Liability

To the fullest extent permitted by law, Aishvera and its officers/employees shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profit/revenue/data arising from your use of the Site or products. Our aggregate liability for any claim shall not exceed the amount paid by you for the order that gave rise to the claim.

19) Indemnity

You agree to indemnify and hold harmless Aishvera from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights.

20) Force Majeure

We are not responsible for delays or failures due to events beyond our reasonable control (e.g., natural disasters, lockdowns, war, strikes, courier disruptions, outages).

21) Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Subject to any applicable dispute-resolution requirements under law, the courts at New Delhi, India, shall have exclusive jurisdiction. Before initiating proceedings, the parties will attempt to resolve disputes amicably by contacting connect@aishvera.com.

22) Changes to Terms

We may update these Terms from time to time. Changes take effect upon posting on the Site with the updated Effective date. Continued use constitutes acceptance of the revised Terms.
